Most civil cases, injury lawsuits included, are heard at the Central Justice Center, the main civil courthouse in Santa Ana. The Costa Mesa Justice Complex handles probate. An unlawful detainer or limited civil case is assigned to whichever justice center serves the property: Harbor (Newport Beach), North (Fullerton), or West (Westminster). Recorded documents, including the Notice of Trustee’s Sale and the Trustee’s Deed Upon Sale, are filed with the Clerk-Recorder’s office in Santa Ana, which is where a surplus-funds claim begins.

Surplus funds after an Orange County foreclosure

When a home here is sold at a trustee’s sale, the price often exceeds the loan balance by a wide margin, and that excess belongs to the former owner or the heirs once the costs of sale and junior liens are paid in order of priority (Civ. Code §2924k). The trustee mails a notice within 30 days of the deed, and the claim, signed under penalty of perjury, is due 30 days after the mailing (Civ. Code §2924j). HOA liens, HELOCs, and second mortgages all compete for the same money, and when priority is disputed the trustee deposits the funds with the superior court in Santa Ana for a hearing. Eviction and possession after a foreclosure

An unlawful detainer summons allows 10 court days for a written response (Code Civ. Proc. §1167) at every Orange County justice center. Fewer Orange County cities have local rent ordinances than in Los Angeles County, but the just-cause and relocation rules of the statewide Tenant Protection Act cover most tenancies past twelve months (Civ. Code §1946.2). After a trustee’s sale, a former owner who remains in the home must receive a 3-day notice to quit first (Code Civ. Proc. §1161a); no unlawful detainer can be filed without it, and a bona fide tenant in the property is entitled to 90 days (Code Civ. Proc. §1161b). Trusts, probate, and contracts

Orange County families with a house and no trust face a probate in Costa Mesa, where statutory fees are figured on the estate’s gross value, mortgage or not (Prob. Code §10810), and the process commonly takes a year or more. A funded revocable living trust keeps the house out of that process. Contract disputes come from every part of the county’s economy, from Irvine technology firms to Anaheim’s tourism businesses to trade contractors in Garden Grove and Santa Ana, and are filed in small claims, limited civil, or unlimited civil depending on the amount in dispute. Written contracts carry a four-year limit and oral agreements two (Code Civ. Proc. §337, §339).
